(Site Planning)

An APPLICATION FOR CERTIFICATE FOR SITE DEVELOPMENT is required to obtain a Certificate for Site Development prior to issue of permits for new construction, reconstruction and new occupancy of an existing building.

A Certificate for Site Development is required for construction or occupancy of a single-family dwelling only if such dwelling is to be located in a flood hazard area.

The Charter Township of Clinton requires that land be properly zoned for any proposed development, use or occupancy. If the existing zoning of the land does not permit the new construction, reconstruction or new occupancy of an existing building, proper zoning shall first be effected under separate APPLICATION TO AMEND THE MAP OF THE PLANNING AND ZONING CODE. An APPLICATION FOR CERTIFICATE FOR SITE DEVELOPMENT will not be accepted unless the land is properly zoned.

Revised Site Plan Approval

Charter Township of Clinton
Revised Site Development Procedures
(Revised Site Planning)

An APPLICATION FOR REVISED CERTIFICATE FOR SITE DEVELOPMENT is required to obtain a Revised Certificate for Site Development prior to issue of permits for the same land in the Charter Township of Clinton as previously received approval for Certificate for Site Development.

A Revised Certificate for Site Development is required for additional new construction or reconstruction of an existing building and for changed occupancy of an existing building on a site which may be not be in accord with current provisions of the Clinton Township Planning and Zoning Code and/or other applicable codes or ordinances.

A Revised Certificate for Site Development is required for any addition to or reconstruction of a single-family dwelling only if such dwelling is located in a flood hazard area.

Rezoning

Charter Township of Clinton
Rezoning Procedures

An APPLICATION TO AMEND THE MAP OF THE PLANNING AND ZONING CODE is required to submit request to the Charter Township of Clinton to enact new legislation to be applicable to the general public.

The Charter Township of Clinton requires that land be properly zoned for any proposed development by new construction or reconstruction, for any use of land and or any new occupancy of an existing building.

An APPLICATION TO AMEND THE MAP OF THE PLANNING AND ZONING CODE shall not be construed as permission to proceed with any development or to establish any use or to occupy any existing building on any land not properly zoned for the proposed development, use or occupancy.

It is the policy of the Clinton Township Planning Commission to make recommendation to the Clinton Township Board to deny an application which, in the opinion of the Planning Commission, is not consistent with the Master Plan for the Charter Township of Clinton.

Thorough understanding by the applicant of all procedures and requirements can be crucial in minimizing costs and delays. The applicant is encouraged to contact the Clinton Township Department of Planning and Community Development prior to filing this application. Discussion of the proposal with a Staff Planner can be an invaluable means to identify and eliminate potential problems.

Information regarding zoning districts, uses and applicable standards is contained in the PLANNING AND ZONING CODE OF THE CHARTER TOWNSHIP OF CLINTON (ORDINANCE NO. 260), as amended.

APPLICATION

This Application to Amend the Map of the Planning and Zoning Code shall be filed with the Clinton Township Department of Planning and Community Development. It is suggested that the applicant file this application in person rather than by mail.

Refusal or failure by an applicant to comply with the following procedures shall constitute sufficient grounds to withhold an application from processing.

The following forms, documents and data shall be the minimum required to file this application. All forms shall contain original signatures notarized as required.

1. One (1) copy of the "APPLICATION TO AMEND THE MAP OF THE PLANNING AND ZONING CODE" form

2. One (1) copy of the "AFFIDAVIT OF OWNERSHIP OF LAND IN THE CHARTER TOWNSHIP OF CLINTON" form

3. One (1) copy of the Township RECEIPT for fee payment

4. One (1) copy of the LEGAL DESCRIPTION of the land

5. One (1) copy of a VICINITY SKETCH

6. One (1) copy each of any OTHER SUPPORTING DATA

If the applicant is not certain that all the data is accurate to complete the application, such spaces on the form should be left blank and the Staff of the Department of Planning and Community Development will assist the applicant in obtaining the correct information.

APPLICANT INFORMATION

The applicant generally is the individual who will attend the meetings of the Clinton Township Planning Commission and the Clinton Township Board and to whom all pertinent correspondence will be addressed.

The applicant may choose to designate a representative. A representative typically serves the interests of the applicant in a technical capacity such as that of project architect, engineer or building contractor. A business partner, attorney or real estate broker may represent the applicant.

The representative shall be empowered to speak and correspond on behalf of the applicant and will receive duplicate correspondence.

The applicant and/or designated representative must be present at each meeting of any commission or board when consideration of the request to amend the map of the Planning and Zoning Code is made.

LAND INFORMATION

Much of the information required to complete this section of the application can be obtained from the property deed or land contract, the latest tax bill or a land survey.

PROJECT INFORMATION

The current use of the land shall be identified.

The existing zoning of the land shall be identified.

The proposed use of the land shall be identified.

The proposed zoning of the land shall be identified.

AFFIDAVIT OF OWNERSHIP

The Affidavit of Ownership of Land in the Charter Township of Clinton is required to identify the titleholder to the land.

If the property is jointly or corporately owned, any one person having authority within a partnership to do so shall sign the affidavit. The separate signature of each owner/partner is not required.

FEE PAYMENT

A non-refundable filing fee, in check or money order made payable to the CLINTON TOWNSHIP TREASURER, shall be paid at the office of the Township Treasurer.

A fee is required in the amount of One Thousand Two Hundred ($1,200.00) Dollars.

LEGAL DESCRIPTION

If the land is unplatted acreage or involves any part of a platted lot, the legal description of the land shall be written in metes and bounds contained in a survey which shall be certified by a licensed professional surveyor registered with the State of Michigan. The application will not be accepted without such certification.

The legal description and the seal of the licensed professional surveyor shall be incorporated onto the vicinity sketch.

If the land is an undivided lot or lots within a platted subdivision, a certified land survey is not required.

VICINITY SKETCH

The vicinity sketch shall be a legible drawing showing the general location of the land identified by the legal description in relation to the nearest intersection of streets or U.S. Government Section Corners.

If the land is unplatted acreage or involves any part of a platted lot, the vicinity sketch shall be certified by a licensed professional surveyor registered with the State of Michigan. The application will not be accepted without such certification.

If the land is an undivided lot or lots within a platted subdivision, certification of the vicinity sketch is not required.

OTHER SUPPORTING DATA

Other supporting data may consist of any additional drawing, document, written statement, evidence, engineering data or information in sufficient detail to explain the basis for the proposed amendment to the map of the Planning and Zoning Code.

PROCESS

The processing of this application will take a minimum of from eighteen (18) to twenty (20) weeks from the date on which this application is filed to the effective date of an ordinance which may be adopted by the Clinton Township Board to amend the map of the Planning and Zoning Code of the Charter Township of Clinton.

A date for the required public hearing on the proposed amendment to the map of the Planning and Zoning Code will be determined at a regular meeting of the Planning Commission. The date of the public hearing which is scheduled by the Planning Commission will be advised to the applicant and/or representative.

The Charter Township of Clinton will cause two publications, in a newspaper of record, of the Notice of Public Hearing to Amend the Map of the Planning and Zoning Code of the Charter Township of Clinton.

The Charter Township of Clinton will issue notice of the public hearing to persons shown on the latest tax roll as owners of land and occupants of each unit of all structures located within three hundred (300) feet of all boundaries of the land and including the land as proposed for rezoning. The Charter Township of Clinton also will issue notice of the public hearing to each electric, gas, pipeline and telephone public utility company and each railroad operating within the Township.

The applicant and/or designated representative must be present at each meeting of any commission or board when consideration of the proposed amendment to the map of the Planning and Zoning Code is made.

At the public hearing, the Clinton Township Planning Commission shall take under consideration and make their recommendation on only the property identified in the application.

The recommendation on the requested amendment to the map of the Planning and Zoning Code will be issued by the Township Department of Planning and Community Development to the Clinton Township Board for their determination.

Upon receipt of the recommendation by the Clinton Township Planning Commission, the Clinton Township Board may take any action permitted or authorized by ordinance and/or statute.

The adoption of an Ordinance to amend the map of the Planning and Zoning Code shall not be construed as permission to proceed with any development or to establish any use or to occupy any existing building on any land not properly zoned for the proposed development, use or occupancy until such adopted Ordinance shall become effective and other assurances to record are made.

The applicant may consult with the Clinton Township Department of Planning and Community Development for information and to obtain the appropriate application for proposed development, use or occupancy.

The applicant may consult with the Clinton Township Department of Building for information regarding Building Permit applications, fees and procedures relevant to proposed development, use or occupancy.

Plat Approval

Platting Procedures

An APPLICATION TO PLAT LAND is required to create any division of an acreage parcel or a recorded lot or to replat any recorded lots.

The Charter Township of Clinton requires that land be properly zoned for any proposed development, use or occupancy. If the existing zoning of the land does not permit the new construction, reconstruction or new occupancy of an existing building, proper zoning shall first be effected under separate APPLICATION TO AMEND THE MAP OF THE PLANNING AND ZONING CODE. An APPLICATION TO PLAT LAND will not be accepted unless the land is properly zoned.

Thorough understanding by the applicant of all procedures and requirements can be crucial in minimizing costs and delays. The applicant is encouraged to contact the Clinton Township Department of Planning and Community Development prior to filing this application. Discussion of the proposal with a Staff Planner can be an invaluable means to identify and eliminate potential problems.

Information regarding platting of land also is contained in Act 168 OF MICHIGAN PUBLIC ACTS OF 1959, ACT 288 OF MICHIGAN PUBLIC ACTS OF 1967, PLANNING AND ZONING CODE OF THE CHARTER TOWNSHIP OF CLINTON (ORDINANCE No. 260), CLINTON TOWNSHIP LAND DEVELOPMENT ORDINANCE NO. 281 OF 1989 and CLINTON TOWNSHIP SUBDIVISION REGULATIONS ORDINANCE NO. 268 OF 1981, all as amended.

If the existing zoning of the land does not permit the platting or replatting as proposed, proper zoning shall first be effected under separate APPLICATION TO AMEND THE MAP OF THE PLANNING AND ZONING CODE. An Application to Plat Land will not be accepted unless the land is properly zoned.

The name of the proposed subdivision to be platted shall be identified.

If the proposed subdivision will be the result of a replat of lots of record, the name of the original recorded subdivision plat and the numbers of the lots in the original recorded subdivision plat shall be identified.

The proposed subdivision shall be identified as a conventional plat or an open-space plat.

The number of lots which will result in the proposed plat shall be indicated.

AFFIDAVIT OF OWNERSHIP

The Affidavit of Ownership of Land in the Charter Township of Clinton is required to identify the titleholder to the land.

AFFIDAVIT OF SUBMITTAL

The Affidavit of Submittal is required to assure that the tentative preliminary plat receives review by the Macomb County Plat Coordinating Committee to ensure that all jurisdictional agents to the platting of land are made aware of the initiation of the proposal and are enabled to advise requirements or offer comments.

LEGAL DESCRIPTION

If the land is unplatted acreage or involves any part of a platted lot, the legal description of the land shall be written in metes and bounds contained in a survey which shall be certified by a licensed professional surveyor registered with the State of Michigan. The application will not be accepted without such certification.

The legal description and the seal of the licensed professional surveyor shall be incorporated onto the preliminary plat.

VICINITY SKETCH

The vicinity sketch shall be a legible drawing showing the general location of the land identified in the application in relation to the nearest intersection of streets or U.S. Government Section Corners.

If the land is unplatted acreage or involves any part of a platted lot, the vicinity sketch shall be certified by a licensed professional surveyor registered with the State of Michigan. The application will not be accepted without such certification.

TOPOGRAPHIC SURVEY

The topographic survey shall be drawn in accord with Clinton Township Subdivision Regulations Ordinance No. 268 and U.S.G.S. datum.

PLAT

The plat shall be drawn in accord with and shall contain all requirements as cited in ACT 168 OF MICHIGAN PUBLIC ACTS OF 1959, ACT 288 OF MICHIGAN PUBLIC ACTS OF 1967, PLANNING AND ZONING CODE OF THE CHARTER TOWNSHIP OF CLINTON, CLINTON TOWNSHIP LAND DEVELOPMENT ORDINANCE NO. 281 OF 1989 and CLINTON TOWNSHIP SUBDIVISION REGULATIONS ORDINANCE NO. 268 OF 1981, all as amended.

OTHER SUPPORTING DATA

Other supporting data may consist of any additional drawing, document, written statement, evidence, engineering data or information in sufficient detail to convey the feasibility and reasonableness of the development.

TENTATIVE APPROVAL OF PRELIMINARY PLAT APPLICATION

The forms, documents and data shall be the minimum required as previously outlined to file with the Clinton Township Department of Planning and Community Development for tentative approval of a preliminary plat.

PROCESS

The initial processing of this application, relevant to acquiring tentative approval of a preliminary plat, will generally take a minimum of from eight (8) to ten (10) weeks from the date on which this application is filed. This period will include a meeting with the Clinton Township Planning Commission for their review and recommendation on the tentative preliminary plat. This period will also include a meeting with the Clinton Township Board for their determination whether to grant tentative approval to the preliminary plat.

Preliminary plats shall comply with all State public acts, Township codes and ordinances and with reviewing agent requirements prior to placement on a Planning Commission agenda.

The preliminary plat shall remain valid for a period of twelve (12) months from the date of tentative approval of the preliminary plat by the Clinton Township Board.

FINAL APPROVAL OF PRELIMINARY PLAT

APPLICATION

The following forms, documents and data shall be the minimum required to file with the Clinton Township Department of Planning and Community Development for FINAL APPROVAL OF PRELIMINARY PLAT.

1. One (1) copy of a LETTER OF REQUEST FOR FINAL APPROVAL of a preliminary plat and containing identification of the location of the land and the name of the proposed plat

2. One (1) copy each of WRITTEN EVIDENCE OF APPROVAL by the:

a. Macomb County Department of Health, if public water and sewer is not available

b. Macomb County Plat Coordinating Committee

c. Macomb County Public Works Commission

d. Macomb County Road Commission, if the proposed plat includes or abuts roads under the jurisdiction of that agency

e. Michigan Department of Highways and Transportation, if the proposed plat includes or abuts roads under the jurisdiction of that agency

f. Michigan Department of Natural Resources, if the proposed plat abuts a lake or stream or river or has a flood plain traversing the land

3. Twenty-Three (23) copies of the final preliminary plat

PROCESS

The processing of a request for final approval of a preliminary plat will generally take a minimum of from two (2) to three (3) weeks from the date on which the letter of request is filed. This period will include a meeting with the Clinton Township Board for their determination whether to grant final approval to the preliminary plat.

A summary of sequential activity, which briefly describes the process and certain documents necessary to acquire final approval of a preliminary plat, is shown as APPENDIX B attached to this application.

Preliminary plats shall comply with all requirements of Act 168 of Michigan Public Acts of 1959, Act 288 of Michigan Public Acts of 1967, Planning and Zoning Code of the Charter Township of Clinton (Ordinance No. 260), Clinton Township Land Development Ordinance No. 281 of 1989 and Clinton Township Subdivision Regulations Ordinance No. 268 OF 1981, all as amended.

A preliminary plat shall remain valid for a period of two (2) years from the date of final approval of a preliminary plat by the Clinton Township Board.

FINAL APPROVAL OF A PLAT

APPLICATION

The following forms, documents and data shall be the minimum required to file with the Clinton Township Department of Planning and Community Development for FINAL APPROVAL OF A PLAT.

1. One (1) copy of a LETTER OF REQUEST FOR FINAL APPROVAL of a plat and containing idenfication of the location of the land and the name of the proposed plat

2. One (1) MYLAR OF THE FINAL PLAT drawn in accord with a containing all requirements as cited in Act 168 of Michigan Public Acts of 1959, Act 288 of Michigan Public Acts of 1967, Planning and Zoning Code of the Charter Township of Clinton (Ordinance No. 260), Clinton Township Land Development Ordinance No. 281 of 1989 and Clinton Township Subdivision Regulations Ordinance No. 268 OF 1981, all as amended

3. One (1) PEN

4. One (1) copy of SUBDIVISION RESTRICTIONS

5. One (1) copy of an INSURANCE POLICY

6. Thirteen (13) PRINTS of the mylar

PROCESS

The processing of a request relevant to acquiring FINAL APPROVAL OF A PLAT will generally take a minimum of from two (2) to three (3) weeks from the date on which the letter of request is filed. This period will include a meeting with the Clinton Township Board for their determination whether to grant final approval to the plat.

SUBDIVISION RESTRICTIONS

If the plat contains a storm-water retention basin, as may be required by the Township Engineer in accord with Clinton Township Land Development Ordinance No. 281, Subdivision Restrictions as intended to be recorded with the final plat shall provide for the creation of an association of owners of land in the subdivision to be served by a storm-water retention basin, the imposition of maintenance expenses upon such owners, affirmation of equal assessment of such owners for maintenance and outline the method for collection of assessments for maintenance.

The Subdivision Restrictions shall further provide that the Charter Township of Clinton, in event the association of owners of land in the subdivision default in maintaining a storm-water retention basin, may take control of such basins, provide maintenance and collect against all owners of land in the subdivision for all actual costs incurred, including engineering and legal fees.

Subdivision Restrictions shall not abridge any rights of the Charter Township of Clinton pursuant to MCL 560.192A.

MYLAR AND PEN

The final plat shall be drawn in accord with and shall comply with all requirements of Act 168 of Michigan Public Acts of 1959, Act 288 of Michigan Public Acts of 1967, Planning and Zoning Code of the Charter Township of Clinton, Clinton Township Land Development Ordinance No. 281 of 1989 and Clinton Township Subdivision Regulations Ordinance No. 268 of 1981, all as amended.

The pen, containing black ink, shall have the capability to impose an acceptable signature impression on the mylar.

Variances

Charter Township of Clinton
Board of Appeals Variance Procedures

This application for Hearing by the Clinton Township Board of Appeals shall be filed with the Department of Planning and Community Development along with the following supporting documentation:

1. One (1) copy of the "Affidavit of Ownership of Land" (see attached)

2. One (1) copy of the Township Receipt for Fee Payment

3. One (1) copy of the legal description of the property

4. Ten (10) copies of a plan, drawn to scale, showing the dimensional

elements for which a variance is requested.

5. One (1) copy of any other supporting data.

FEE PAYMENT

A non-refundable filing fee shall be paid at the office of the Township Treasurer. A copy of the receipt for payment must be submitted with this application. A fee of $75.00 is required for all single-family zoned property and a fee of $300 is required for all non single-family zoned property.

PROCESS

The processing of this application will take a minimum of four (4) to six (6) weeks from the date on which the application is accepted.

A public hearing will be scheduled by the Clinton Township Board of Appeals. The applicant will be notified of the public hearing date by the Department of Planning and Community Development.

Not less than eight (8) days prior to the scheduled hearing date, the Township will notify all owners of land, as shown on the latest tax roll, within 300 feet of the subject property, of the time, date, place and purpose of the public hearing.

At the public hearing, the Clinton Township Board of Appeals shall take under consideration only the property described in the application.

The Board of Appeals may approve (with or without modifications or conditions) or deny the request for variance.

The Board of Appeals shall not approve a request for variance unless it has been found positively that,

1. The strict enforcement of the Zoning Ordinance would cause practical difficulty and deprive the owner of rights enjoyed by all other property owners owning property within the same zoning district.

2. The conditions and circumstances are unique to the subject property and are not similarly applicable to other properties in the same zoning district.

3. The conditions and circumstances unique to the property were not created by the owner, or his predecessor in title, within the time following the effective date of the provisions alleged to adversely affect such property.

4. The requested variance will not confer special privileges that are denied other properties similarly situated and in the same zoning district.

5. The requested variance will not be contrary to the spirit and intent of the Clinton Township Planning and Zoning Code.

6. The requested variance will not adversely affect the purpose or objectives of the Clinton Township Master Plan.

VALID PERIOD OF A GRANTED VARIANCE

A request for variance granted by the Clinton Township Board of Appeals shall remain valid as long as the information and data relating thereto are true and correct and any conditions upon which the grant of variance was based are maintained.

The decision of the Clinton Township Board of Appeals shall be final, however, any person having an interest affected by any decision of the Clinton Township Board of Appeals has the right of appeal to the Macomb County Circuit Court.

Special Land Use Approval

Special Land Use Procedures

An APPLICATION FOR SPECIAL LAND USE APPROVAL AND CERTIFICATE FOR SITE DEVELOPMENT is required to obtain a Certificate for Site Development prior to issue of permits for new construction, reconstruction and new occupancy of an existing building on land with any use requiring special approval.

The Charter Township of Clinton requires that land be properly zoned for any proposed development, use or occupancy permitted under special approval. If the existing zoning of the land does not permit the new construction, reconstruction or new occupancy of an existing building in the zoning district in which the land lies, under certain requirements and conditions subject to special approval, proper zoning shall first be effected under separate APPLICATION TO AMEND THE MAP OF THE PLANNING AND ZONING CODE. An APPLICATION FOR SPECIAL LAND USE APPROVAL AND CERTIFICATE FOR SITE DEVELOPMENT will not be accepted unless the land is properly zoned.

1. One (1) copy of the "APPLICATION FOR SPECIAL LAND USE APPROVAL AND CERTIFICATE FOR SITE DEVELOPMENT" form

2. One (1) copy of the "AFFIDAVIT OF OWNERSHIP OF LAND IN THE CHARTER TOWNSHIP OF CLINTON" form

3. One (1) copy of the Township RECEIPT for fee payment

4. One (1) copy of the LEGAL DESCRIPTION of the land

5. Two (2) copies of a FLOOR PLAN

6. Two (2) copies of a BUILDING ELEVATIONS PLAN

7. Two (2) copies of a LANDSCAPE PLAN

8. Eleven (11) copies of the SITE DEVELOPMENT PLAN (Note: If the development fronts Gratiot or Groesbeck, we will require fourteen (14) copies; if the development fronts Hall Road (M-59), we will require seventeen (17) copies).

9. Two (2) copies each of any OTHER SUPPORTING DATA

If the applicant is not certain that all the data is accurate to complete the application, such spaces on the form should be left blank and the Staff of the Department of Planning and Community Development will assist the applicant in obtaining the correct information.

APPLICANT INFORMATION

The applicant generally is the individual who will attend meetings of the Clinton Township Planning Commission and the Clinton Township Board and to whom all pertinent correspondence will be addressed.

The applicant may choose to designate a representative. A representative typically serves the interests of the applicant in a technical capacity such as that of project architect, engineer or building contractor. A business partner, attorney or real estate broker may represent the applicant.

The representative shall be empowered to speak and correspond on behalf of the applicant and will receive duplicate correspondence.

The applicant and/or designated representative must be present at each meeting of any commission or board when consideration of the special land use and site development plan is made.

LAND INFORMATION

Much of the information required to complete this section of the application can be obtained from the property deed or land contract, the latest tax bill or a land survey.

PROJECT INFORMATION

The Charter Township of Clinton requires that land be properly zoned for any proposed development, use or occupancy. If the existing zoning of the land does not permit the development, use or occupancy of the site as proposed, proper zoning shall first be effected under separate APPLICATION TO AMEND THE MAP OF THE PLANNING AND ZONING CODE. An Application for Special Land Use Approval and Certificate for Site Development will not be accepted unless the land is properly zoned.

The name of the proposed development shall be identified.

The proposed use of the land shall be identified.

AFFIDAVIT OF OWNERSHIP

The Affidavit of Ownership of Land in the Charter Township of Clinton is required to identify the titleholder to the land.

If the property is jointly or corporately owned, any one person having authority within a partnership to do so shall sign the affidavit. The separate signature of each owner/partner is not required.

FEE PAYMENT

A non-refundable filing fee, in check or money order made payable to the CLINTON TOWNSHIP TREASURER, shall be paid at the office of the Township Treasurer.

A fee is required in the amount of One Thousand Two Hundred ($1,200.00) Dollars.

LEGAL DESCRIPTION

If the land is unplatted acreage or involves any part of a platted lot, the legal description of the land shall be written in metes and bounds contained in a survey which shall be certified by a licensed professional surveyor registered with the State of Michigan. The application will not be accepted without such certification.

The legal description and the seal of the licensed professional surveyor shall be incorporated onto the site development plan.

If the land is an undivided lot or lots within a platted subdivision, a certified land survey is not required.

FLOOR PLAN

The floor plan shall indicate the dimensions and uses of all interior spaces.

BUILDING ELEVATIONS PLAN

The building elevations plan shall indicate the maximum height of all structures and the general architectural design of all facets of each structure.

LANDSCAPE PLAN

The landscape plan shall indicate the species, location and height of all proposed plant materials.

Information regarding preparation of a landscape plan is contained in the PLANNING AND ZONING CODE OF THE CHARTER TOWNSHIP OF CLINTON. The applicant is advised to assure that the preparer of the landscape plan uses the most current issue of the PLANNING AND ZONING CODE, as amended.

SITE DEVELOPMENT PLAN

The site development plan shall provide an overview of the development proposed for the site, the site relation to adjacent lands and public rights-of-way, the location and dimensions of all existing structures, proposed structures, parking areas, maneuvering lanes, approach drives, sidewalks, walls, fences and other salient features.

The site development plan shall be drawn in accord with and shall contain all requirements as cited in the provisions of the PLANNING AND ZONING CODE OF THE CHARTER TOWNSHIP OF CLINTON chapter relevant to Site Plan Review (All Districts).

OTHER SUPPORTING DATA

Other supporting data may consist of any additional drawing, document, written statement, evidence, engineering data or information in sufficient detail to convey the feasibility and reasonableness of the development.

PROCESS

The processing of this application will take a minimum of from fifteen (15) to eighteen (18) weeks from the date on which you file this application to the issuance of a Certificate for Site Development. This period will include a public hearing with the Clinton Township Planning Commission for their review and recommendation on the proposed special land use and the accompanying site development plan. This period will also include a meeting with the Clinton Township for their determination on the proposed special land use and the accompanying site development plan.

All plans submitted with this application shall be prepared by a professional engineer or professional architect or professional landscape architect or professional community planner, all of which shall be licensed and/or registered with the State of Michigan, and shall be drawn in accord with the requirements of the most current issue PLANNING AND ZONING CODE OF THE CHARTER TOWNSHIP OF CLINTON, as amended.

The applicant is advised to assure that the preparer of the site development plan uses the most current issue of the Planning and Zoning Code, as amended.

The application process involves a series of submittals of copies of the site development plan and includes a public hearing by the Clinton Township Planning Commission. It is recommended that not more copies of the plan or supporting data than the required number be submitted at any time during the process. The applicant will be advised when to provide additional copies of the plan or any other data.

The first filing of site development plans will be the issue as submitted with this application.

The application, site development plan and applicable supporting data will be issued by the Township Department of Planning and Community Development to various agencies for general review and comment.

Some reviewing agents may advise you directly of their required changes to the site development plan. It is suggested that individual changes not be made to the plan based upon the directive of an independent reviewing agent. The Staff Planner assigned to analyze the proposal will advise the applicant and representative of all revisions which will be required.

A site development plan shall comply with all Township ordinance and code and reviewing agent requirements prior to placement on a Planning Commission agenda.

If features of the property, not within the control of the applicant and not in contradiction to the restrictions permitting any special land use, present practical difficulty or unnecessary hardship in the ability to meet the requirements of the Planning and Zoning Code, a separate Application for Hearing by the Clinton Township Board of Appeals may be filed. The appeal process will add six (6) to eight (8) weeks to the process.

A self-imposed difficulty or hardship is not an acceptable claim under the intent of the Application for Hearing by the Clinton Township Board of Appeals.

The second filing of site development plans shall be of such issue as has been determined in accord with all Township ordinance requirements.

A date for the required public hearing on the proposed special land use and accompanying site development plan will be determined at a regular meeting of the Planning Commission.

The date of the public hearing which is scheduled by the Planning Commission will be advised to the applicant and/or representative.

The Charter Township of Clinton will cause publication, in a newspaper of record, of the Notice of Public Hearing for Special Land Use Approval.

The Charter Township of Clinton will issue notice of the public hearing to persons shown on the latest tax roll as owners of land and to occupants of each unit of all structures located within three hundred (300) feet of all boundaries of the land and including the land proposed for special land use and site development.

The site development plan and applicable supporting data will be issued by the Township Department of Planning and Community Development to the Clinton Township Planning Commission for review and recommendation coordinate with their consideration of the request for special land use at the public hearing.

The applicant and/or designated representative must be present at each meeting of any commission or board when consideration of the special land use and accompanying site development plan is made.

The third filing of site development plans, including landscape plans, will be subsequent to the public hearing and shall be of such issue upon which the Clinton Township Planning Commission has based their recommendation on the request for special land use and their recommendation on the accompanying site development plan.

The request for special land use, site development plan and landscape plan will be issued by the Township Department of Planning and Community Development to the Clinton Township Board for their determination.

The approval of the special land use shall lie with the land, however, any subsequent actions relating to the activity as authorized shall be in compliance with the approved site development plan and accompanying landscape plan.

The site development plan and landscape plan approved by the Clinton Township Board shall become part of the record of Township Board approval of the special land use and any conditions which may be imposed upon the site development plan and/or landscape plan shall remain unchanged, except such changes as conform to the Planning and Zoning Code of the Charter Township of Clinton, as amended, and which receive the mutual consent of the Clinton Township Board and the landowner.

The Certificate for Site Development will be issued by the Township Department of Planning and Community Development after receipt of notice of approval of the special land use, site development plan and landscape plan by the Clinton Township Board.

The Certificate for Site Development is valid for a period of eighteen (18) months from the date of approval by the Clinton Township Board of the special land use, the site development plan and landscape plan, during which time a Building Permit to proceed with the development of the land shall be obtained.

If a Building Permit is not obtained during the valid period of the Certificate for Site Development and the applicant desires to proceed with the development, a new Application for Special Land Use Approval shall be filed.

Any revision to an approved site development plan or an approved landscape plan shall require an APPLICATION FOR REVISED CERTIFICATE FOR SITE DEVELOPMENT.

The applicant may consult with the Clinton Township Department of Planning and Community Development for information and to obtain the appropriate application.

The applicant may consult with the Clinton Township Department of Building for information regarding Building Permit applications, fees and procedures.
