Mr. Woodring called the meeting to order at 6:30 p.m.

APPROVAL OF AGENDA

Mr. Cassin stated there was an addition to the agenda. Petition from Benny Sorrentino.

Motion by Mr. Landa, supported by Mr. Roach, to approve the agenda as amended. Motion carried.

LOT 1, JOHN F. SASS SUBDIVISION AND ADJACENT ACREAGE (SECTION 2)
- PROPOSED REZONING FROM R-5 ONE-FAMILY RESIDENTIAL TO TR
TECHNICAL RESEARCH

Pertinent correspondence was read and entered into the record. Ms. Trombley noted that

23 notices were mailed to owners and occupants within 300 feet of the subject property and 5 were returned.

Mr. Woodring explained the procedure for a Public Hearing to be as follows: the petitioner will make comments, the public will have an opportunity to ask questions and the Planning Commission will have opportunity to make comments or ask questions.

Vito Licata, Shores Property Holding, 16585 Thirteen Mile Road, Fraser, Michigan 48026, stated he and his partner purchased the subject property from the State of Michigan after the M-59 road expansion. He added that in his opinion, this zoning is the best buffer for the adjoining residential property. They are considering developing a Dentist office.

Mr. Woodring stated that a Dentist office is not suitable for a TR Research zoning.

Harold Fiebelkorn, 44833 Maddelein Drive, Clinton Township, Michigan 48036, stated that he was told that the area would automatically be rezoned commercial with the expansion of Hall Road.

Mr. Cassin stated that there are no properties that are automatically rezoned.

Mr. Fiebelkorn inquired as to the required setbacks for the subject property.

Mr. Cassin stated that the required setback from residential property is fifty (50) feet and twenty-five (25) feet from Hall Road.

Mr. Woodring inquired as the square footage for the subject property.

Mr. Licata stated the property is 180x95 feet.

Mr. Cassin stated the petitioner has a right to request variances to the setbacks based on hardship.

Robert Schlief, 44740 Maddelein, Clinton Township, Michigan 48036, inquired as to what the TR Research zoning allows.

Mr. Cassin stated TR Research allows Education Research, Design for Industrial, Data Processing, etc.

Mr. Fiebelkorn inquired as to what will happen with the additional vacant lots in the area.

Mr. Woodring stated that every property owner has a right to petitioner for rezoning. It doesn’t mean that the rezoning will be approved.

Mr. Schlief inquired as to whether the surrounding neighbors of the subject property will be notified of the site plan meeting.

Mr. Woodring stated that if the rezoning is approved, the site plan meeting does not require a public hearing. He stated that Mr. Cassin or the petitioner could notify the surrounding residents of the site plan meeting.

Mr. Catalano inquired as to whether the petitioner could request a variance if the property is not rezoned.

Mr. Cassin stated that a variance could not be requested if the rezoning is denied.

Mr. Landa stated there is not enough room without a variance to develop.

Mr. Cassin stated that the required setbacks can be used for parking. In addition, he added that a variance is needed regardless of the zoning.

Mr. Catalano inquired as to whether the petitioner tried to purchase additional property.

Mr. Licata stated that he did not attempt to purchase additional property. He added that the proposed rezoning is suitable for the piece of property he owns.

Motion by Mr. Roach, supported by Ms. Braswell, with reference to File #5243 and application from Vito Licata, Shores Property Holding, 16585 Thirteen Mile Road, Fraser, Michigan 48026, concerning request for rezoning from R-5 One-Family Residential to TR Technical Research for Lot 1, John F. Sass Subdivision and adjacent acreage (Section 2), generally located at the southeast corner of Hall Road (M-59) and Maddelein Drive, that recommendation for approval of rezoning based on the recommendation from the Planning Department from R-5 One-Family Residential to TR Technical Research be submitted to the Township Board. Roll Call Vote: Aye- Roach, Braswell, Landa, Woodring, Trombley. Nay- Catalano. Absent- Dedenbach, Gudobba, Tomlinson. Motion carried.

PART OF LOT 14, AND LOT 15, FORTON INDUSTRIAL SUBDIVISION (SECTION 26)

Pertinent correspondence was read and entered into the record.

Lynn Darmes, 23309 Quinn Road, Clinton Township, Michigan 48035, representative stated they are proposing to develop a new office building for Icon Building II Company, Inc.

Mr. Woodring inquired as to whether there will be a berm.

Mr. Cassin stated there will be a berm along the front.

Motion by Mr. Landa, supported by Ms. Braswell, with reference to File #0443 and application from Benny Sorrentino, Icon Building II Company, Inc., 23309 Quinn Road, Clinton Township, Michigan 48035, as represented by Lynn Darmes, Icon Building II Company, Inc., 23309 Quinn Road, Clinton Township, Michigan 48035, concerning request for recommendation for approval of Site Development Plan for Forton Industrial Building #15, located on part of Lot 14, and Lot 15 of Forton Industrial Subdivision, generally fronting the east line of Forton Court and north of 15 Mile Road, that recommendation for approval of the site development plan be submitted to the Township Board. Roll Call Vote: Aye- Landa, Braswell, Catalano, Roach, Woodring, Trombley. Nay- None. Absent- Dedenbach, Gudobba, Tomlinson. Motion carried.

ADJOURNMENT

Motion by Mr. Roach, supported by Mr. Landa, to adjourn the meeting. Motion carried. Meeting adjourned at 7:02 p.m.
