Mr. Woodring called the meeting to order at 6:30 p.m.

APPROVAL OF AGENDA

Motion by Mr. Landa, supported by Mr. Catalano, to approve the agenda as submitted. Motion carried.


4.33 (PART OF 8.67) ACRES LOCATED AT THE SOUTHWEST CORNER OF HALL ROAD (M-59) AND HEYDENREICH ROAD (SECTION 4)
- PROPOSED REZONING FROM I-1 LIGHT INDUSTRIAL TO B-3 GENERAL BUSINESS

Pertinent correspondence was read and entered into the record. Ms. Trombley noted that 58 notices were mailed to owners and occupants within 300 feet of the subject property and two (2) were returned.

Mr. Woodring explained the procedure for a Public Hearing to be as follows: the petitioner will make comments, the public will have an opportunity to ask questions and the Planning Commission will have opportunity to make comments or ask questions.

Anthony Vitale, Anderson, Eckstein and Westrick, Inc., 51301 Schoenherr Road, Shelby Township, Michigan 48315, representative, stated that the petitioner would prefer B-3 zoning. He stated that the petitioner will consider B-3 zoning with restrictions.

Nancy Grebe, 20458 Villa Grande Cr., Clinton Township, Michigan 48038, President
of the Villa Grande Association, stated concerns about the use of the land. She inquired
as to the differences between B-2 zoning and B-3 zoning. She added that they prefer
Business uses over Industrial.

Mr. Tomlinson stated that when the matter was previously heard, the petitioner stated they would not use the subject property for Commercial uses.

Vincenza Vitale, 44405 Thunderbay, Clinton Township, Michigan 48038, stated that they had a tenant for Industrial use and now that tenant wants a Commercial use. She added the building was developed for an Industrial use.

Mr. Tomlinson inquired as to whether the petitioner would be willing to accept a B-1 use.

Ms. Vitale stated she wants a B-3 zoning because of the height and size of the building.

Mr. Cassin stated there is very little difference between B-2 zoning and B-3 zoning with the major exception that B-3 zoning permits adult uses, tattoo parlors and massage parlors.

Ms. Dedenbach inquired as to the permitted uses for B-1 zoning.

Mr. Cassin stated B-1 restricts uses to neighborhood Commercial uses such as drug stores and grocery stores.

Ms. Dedenbach stated her opinion that the building looks more like it was developed for commercial uses.

Mr. Vitale stated that they tried to make the building presentable because it is on a main road. They plan to use the building for Industrial uses with a retail end. He added that there was a misunderstanding.

Mr. Gudobba inquired as to whether the original tenant looked at the building design prior to development.

Mr. Vitale stated that one tenant wanted to operate a collision shop.

Ms. Trombley stated she is not agreeable to B-3 zoning for the subject property. She added that if the petitioner waits longer, they may be able to find tenants for B-2 zoning.

Mr. Catalano inquired as to whether the petitioner is agreeable to B-2 zoning as recommended by the Planning Department.

Mr. Vitale stated that the petitioner is agreeable to B-2 zoning.

Don Loranger, 18237 Whitmore Court, Clinton Township, Michigan, stated that the petitioner
intended to develop the land as Light Industrial and is having a hard time finding tenants.

Mr. Woodring inquired as to the parking requirements for Commercial uses and Industrial uses.

Mr. Cassin stated that Industrial parking requirements are calculated as 1 parking space for every six-hundred and twenty-five (625) square feet and Commercial is calculated as 2 parking spaces for every six-hundred and twenty-five (625) square feet.

Motion by Mr. Catalano, supported by Mr. Landa, with reference to File #5251 and application from Mrs. Vincenza Vitale, 44405 Thunderbay, Clinton Township, Michigan 48038, as represented by Anderson, Eckstein and Westrick, Inc., 51301 Schoenherr Road, Shelby Township, Michigan 48315, concerning request for recommendation for approval of proposed rezoning from I-1 Light Industrial to B-3 General Business for 4.33 (Part of 8.67) acres located at the southwest corner of Hall Road (M-59) and Heydenreich Road (Section 4), that recommendation for denial be submitted to the Township Board. Roll Call Vote: Aye- Catalano, Landa, Dedenbach, Gudobba, Tomlinson, Woodring, Trombley. Nay- None. Absent- Braswell, Roach. Motion carried.

Motion by Mr. Landa, supported by Mr. Catalano, with reference to File #5251 and application from Mrs. Vincenza Vitale, 44405 Thunderbay, Clinton Township, Michigan 48038, as represented by Anderson, Eckstein and Westrick, Inc., 51301 Schoenherr Road, Shelby Township, Michigan 48315, concerning request for recommendation for approval of proposed rezoning from I-1 Light Industrial to B-2 Community Business for 4.33 (Part of 8.67) acres located at the southwest corner of Hall Road (M-59) and Heydenreich Road (Section 4), that recommendation for approval be submitted to the Township Board based on the recommendation by the Planning Department. Roll Call Vote: Aye- Landa, Catalano, Dedenbach, Gudobba, Woodring, Trombley. Nay- Tomlinson. Absent- Braswell, Roach. Motion carried.

Pertinent correspondence was read and entered into the record. Ms. Trombley noted that 18 notices were mailed to owners and occupants within 300 feet of the subject property and none were returned. Ms. Trombley stated that one letter was received from Elisa De Ponio, 37075 Utica, Clinton Township, Michigan 48036, stated opposition to the rezoning.

Mr. Woodring explained the procedure for a Public Hearing to be as follows: the petitioner will make comments, the public will have an opportunity to ask questions and the Planning Commission will have opportunity to make comments or ask questions.

John Vesper, Vena Professional Center, 42100 Garfield, Clinton Township, Michigan 48038, representative, stated he is willing to answer questions.

Elisa De Ponio, 37075 Utica, Clinton Township, Michigan 48036, resides on the property

that was listed as vacant in the correspondence.

Mr. Cassin stated that the vacant property referred to in the correspondence is an easement owned by the Township. Her property abuts the easement.

Mrs. De Ponio stated she bought her property because of the privacy and objects to the

rezoning. She added that the rezoning will decrease her property value.

Ms. Dedenbach stated the there is a medical building on the corner and the subject property abuts land that is zoned commercial. She added that the rezoning will enhance the property values in the area.

Mr. Cassin stated that if Ms. De Ponio sold her property as commercial property, it would enhance her property values.

Mr. Gudobba inquired as to the possibility of limiting one access to Utica Road when site plan review is made.

Mr. Vesper stated that the building will be set back off Utica Road. He added that they are agreeable to a common driveway.

Motion by Mr. Gudobba, supported by Ms. Trombley, with reference to File #5254 and application from John Vesper, Vena Professional Center, 42100 Garfield, Clinton Township, Michigan 48038, concerning request for recommendation for approval of proposed rezoning form R-2 One-Family Residential, to OS-1 Office/Service (Low-Rise), for 2.468 acres located at the northwest corner of Metropolitan Parkway and Utica Road (Section 30), that recommendation for approval of the rezoning as requested be submitted to the Township Board. Roll Call Vote: Aye- Gudobba, Trombley, Catalano, Dedenbach, Landa, Tomlinson, Woodring. Nay- None. Absent- Braswell, Roach. Motion carried.


LOT #15-18, INGLESIDE FARMS SUBDIVISION (SECTION 27)

Pertinent correspondence was read and entered into the record.

Michael Bujanowski, Pinnacle Building Services Inc., 27970 Metro Villa Drive, Suite 105-E, Harrison Township, Michigan 48045, representative, stated the petitioner has purchased additional property. He added that the development is an improvement to the area.

Mr. Gudobba inquired as to whether the variance granted for the subject property is still applicable with the addition of property.

Mr. Cassin stated that the variance granted is applicable to the property it was granted for.

Mr. Gudobba stated his opinion that if the petitioner was able to purchase additional property, it should have been used for additional parking. He added that he does not support the driveway access to the residential area.

Mr. Bujanowski stated that the driveway will be used more for entrance than exit.

Mr. Gudobba inquired as to who owned Lot #130.

Mr. Bujanowksi stated that the petitioner owns the 1st house and the owner of Lot #232 is not ready to sell his property. He added that the back property will be split and the rear portion of that property will be used for parking when the petitioner is able to purchase Lot #232.

Mr. Catalano stated that with the additional land purchase, the petitioner could have made the building smaller and added additional parking.

Mr. Bujanowski stated that the previous tenant did not have any parking problems. He added that the new tenant will have less volume of traffic.

Mr. Tomlinson stated opposition to the project based on the need for additional parking.

Ms. Dedenbach stated that in the previous public hearings, the surrounding residents wanted the driveway to the residential area.

Motion by Ms. Dedenbach, supported by Mr. Landa, with reference to File #1303 and application from Hazim Attiasha, 10821 Oak Park Blvd., Oak Park, Michigan 48237, as represented by Michael Bujanowski, Pinnacle Building Services Inc., 27970 Metro Villa Drive, Suite 105-E, Harrison Township, Michigan 48045, concerning request for approval of revised site development plans for Attisha Retail located on Lot #15-18, Ingleside Farms Subdivision (Section 27), generally fronting the west line of Gratiot Avenue and south of Metropolitan Parkway (16 Mile), that approval of the Revised Site Development be submitted to the Township Board. Roll Call Vote: Aye- Dedenbach, Landa. Nay- Catalano, Gudobba, Tomlinson, Woodring, Trombley. Absent- Braswell, Roach. Motion failed.

Steve Pangori, Anderson, Eckstein and Westrick, Inc., 51301 Schoenherr Road, Shelby Township, Michigan 48315, representative, stated they are in the process of combining the properties. This should be completed in 1 week to 10 days.

Mr. Tomlinson inquired as to the definition for a "surgical site".

Michael St. Germain, SSOE, Inc., 1050 Wilshire Drive, Suite 260, Troy, Michigan 48084, stated the term is site specific and will be used as an ambulatory surgery center.

Ms. Dedenbach inquired as to whether additional parking that is not shown on the site plan is necessary.

Mr. Cassin stated that the ordinance does not require additional parking for the outpatient site.

Motion by Mr. Gudobba, supported by Mr. Tomlinson, with reference to File #0410 and application from Michael St. Germain, SSOE, Inc., 1050 Wilshire Drive, Suite 260, Troy, Michigan 48084, as represented by Steve Pangori, Anderson, Eckstein and Westrick, Inc., 51301 Schoenherr Road, Shelby Township, Michigan 48315, concerning request for approval of revised site development plan for St. Joseph’s Mercy Hospital, West, located on Part of 31.827 acres of land fronting the North line of 19 Mile Road, east of Hayes Road (Section 6), that approval of the Revised Site Development Plan be submitted to the Township Board, subject to the petitioner obtaining approval from the Township Assessor, of an application to "combine" properties owned by the Hospital, prior to a site development "CERTIFICATE" being issued. Roll Call Vote: Aye- Gudobba, Tomlinson, Catalano, Dedenbach, Landa, Woodring, Trombley. Nay- None. Absent- Braswell, Roach. Motion carried.

APPROVAL OF REPORTS

Motion by Mr. Landa, supported by Ms. Dedenbach, to approve the reports of meetings for Thursday, August 27, 1998, Thursday, September 10, 1998 and Thursday, September 24, 1998, as submitted. Motion carried.
