Mr. Woodring called the meeting to order at 6:31 p.m.
APPROVAL OF AGENDA
Motion by Mr. Gudobba, supported by Ms. Dedenbach, to approve the agenda as submitted. Motion carried.

MF #5206: PETITIONED BY GERALD "BRUNO" BURNOSKY
Pertinent correspondence was read and entered into the record. Ms. Trombley noted that 57 notices were mailed to owners and occupants within 300 feet of the subject property and none were returned.
Mr. Woodring explained the procedure for a Public Hearing to be as follows: the petitioner will make comments, the public will have an opportunity to ask questions and the Planning Commission will have opportunity to make comments or ask questions.
Gerald "Bruno" Burnosky, Brunos Dive Shop, 34736 Gratiot Avenue, Clinton Township, Michigan 48035, stated that he has been living and working in the area for twenty (20) years. He has received awards for his work in the area. He is proposing to develop a pool which, in his opinion, will enhance his business and the Township.
Gloria Shines, 33751 Florence, Clinton Township, Michigan 48035, stated that there is already a traffic problem with the current business and feels that the addition of the pool will create more traffic. She stated that she is opposed to the rezoning.
Garry ONeal, 21700 Vermander, Clinton Township, Michigan 48035, stated that he is opposed to the rezoning. In his opinion, if the rezoning is approved it would be spot zoning.
Rosa Lee Shackelford, 21650 Vermander, Clinton Township, Michigan 48035, stated opposition to the rezoning.
Resident, 21820 Sharkey, Clinton Township, Michigan 48035, stated his opinion that no one else but the petitioner benefits with the rezoning.
Mr. Burnosky stated that he works with the community and plans to offer classes for swimming and scuba diving. He added that his classes are accredited by the State of Michigan.
Mr. Tomlinson inquired as to the distance from Gratiot that the rezoning will be.
Mr. Cassin stated it will be 400-500 feet from Gratiot Avenue.
Mr. Roach inquired as to whether this will be spot zoning.
Mr. Cassin stated that spot zoning refers to an area rezoned that is not currently in the area. He added that the proposed rezoning will be an extension of an area that is currently zoned the same.
Ms. Dedenbach stated that the petitioner has been working on this project for a long time and favors the rezoning.
Mr. Gudobba stated that the area currently has a traffic problem and the area across the street is residential. He added that the Planning Commission tries to limit the number of accesses from businesses to residential streets. He suggested that the Planning Department study exactly how far back the rezoning should be.
Mr. Catalano stated that the Ordinance Update Committee has been reviewing the Master Plan to rezone from 15 Mile to Kentucky Street, but as of yet no decisions have been made.
Mr. Landa stated that he has concerns that this will increase traffic problems in the area.
Ms. Braswell inquired as to how much land is being rezoned.
Mr. Cassin replied that the parcel measures approximately 200 feet x 200 feet.
Ms. Braswell inquired as to what business is north of the proposed rezoning.
Mr. Cassin stated that the land north of the proposed rezoning is developed with a Pizza Hut and a Bar.
Ms. Braswell inquired as to how deep the rezoning is for that property.
Mr. Cassin stated that it is 500 feet and deeper along Sharkey.
Ms. Braswell inquired as to where the petitioner will tap into the sewer line.
Mr. Cassin stated that the sewer line issue would be discussed at the Site Plan approval level if the rezoning is approved. He stated that the Township Engineers will have to review.
Ms. Braswell stated that she is opposed to the rezoning unless the entire area is rezoned.
Mr. Roach knows first hand that Mr. Burnosky works with the community but has problems with rezoning so deep into a residential area until the Master Plan is reviewed as to whether the entire area will be rezoned.
Mr. Woodring stated that in 1983 the area along Gratiot between 14 Mile & 15 Mile was rezoned to Commercial, is now developed and has improved the area.
Mr. Burnosky stated that when Gratiot Avenue was widened, he had to move the parking for his building across the street.
Ms. Shine stated that the area is residential and she would like it to remain residential.
Mr. Catalano inquired as to when the petitioner plans to start building the pool.
Mr. Burnosky stated he plans to start building this fall.
Mr. Gudobba inquired as to whether the pool could be built where the parking is located now.
Mr. Burnosky stated that he has worked with the Planning Department and the proposed location is the only feasible one.
Mr. Gudobba stated he would prefer the matter be studied prior to the rezoning.
Motion by Ms. Dedenbach, supported by Mr. Roach, with reference to File #5206 and application from Gerald "Bruno" Burnosky, Brunos Dive Shop, 34736 Gratiot Avenue, Clinton Township, Michigan 48035, concerning request for recommendation for approval of rezoning from R-5 One-Family Residential to B-3 General Business for Brunos Dive Shop located on Lots 16-19 and Lots 38-41, Block C, Gratiot Heights Subdivision (Section 34), generally located east of Gratiot Avenue, fronting the north line of Vermander and the south line of Abrahm, that recommendation for approval be submitted to the Township Board based on the recommendation by the Planning Department. Mr. Gudobba inquired as to whether the petitioner is agreeable to sign a covenant with Clinton Township for future paving of Hengesbech Avenue.
Mr. Lesniewski stated he is agreeable to the covenant.
Mr. Tomlinson inquired as to whether a pole barn is allowed for this project.
Mr. Cassin stated that for a landscape company, a pole barn is allowed.
Motion by Mr. Catalano, supported by Ms. Braswell, with reference to File #5154 and application from Herman Lesniewski, Green and Sharpe, 40134 Sara Rose, Clinton Township, Michigan 48038, concerning request for recommendation of approval of Site Development Plans for Green and Sharpe Landscape Supply Yard, located on Lots 93 & 94 Hengesbech Subdivision (Section 26), generally located fronting the west line of Hengesbach, north of 15 Mile Road, that recommendation for approval be submitted to the Township Board subject to: 1) the off-street parking space being widened to 12 feet and designated "barrier free"; 2) tree species and height must be listed on the plans prior to being submitted to the Township Board and 3) that the petitioner sign a covenant prepared by the Township attorney indicating that he will agree to pave Hengesbach Avenue at a furture date to be determined by the Township. Mr. Catalano stated that the original Site Plan is from 1986 and stated his opinion that a new Site Plan should be used instead of revising the previous one due to the length of time since the original.
Mr. Tomlinson inquired as to whether the petitioner has a tenant for the proposed building.
Antonio Roselli, 17474 Iris Circle, Clinton Township, Michigan 48036, stated there is not currently a tenant, although the other building on the property is leased. He stated that he usually builds before finding a tenant.
Mr. Roach inquired as to how long the waiver for the sidewalk will remain.
Mr. Cassin stated that the waiver for the sidewalk is permanent.

William Roney, Paragon Properties Co., 32400 Telegraph Road, Suite 202, Bingham Farms, Michigan 48025, representative, stated that this issue has never been brought to the petitioner. He added that because he was not aware of the required wall, they have granted easements to utilities companies for this part of the property and it is nearly impossible to place a wall.
Bill Poma, 43660 Hayes, Clinton Township, Michigan, stated that he was told his property was accidentally zoned commercial and then rezoned residential. He would like a wall for a buffer from the adjacent property. He stated currently there are traffic problems.
Mr. Roney stated that a wall is not indicated on the original site plan. In response to the traffic from the apartment complex, he stated that just as many cars drive down Hayes Road as exit from the complex.
Mr. Tomlinson inquired as to whether the sidewalk should be shown on the entire property. He added that the Mr. Poma has stated that in the future he might consider rezoning the property to B-1.
Mr. Cassin stated that the sidewalk should be on the entire property.
Mr. Roney stated he will revise the site plans to show the sidewalk on the entire property.
Mr. Gudobba inquired as to whether additional landscaping could be placed to provide more screening.
Mr. Cassin stated that the Planning Commission could refer the matter to the Landscape Committee, although the Planning Department feels there is adequate screening.
