Mr. Woodring called the public hearing to order at 6:30 p.m.

1.147 ACRE FRONTING THE EAST LINE OF HAYES ROAD, BETWEEN UTICA ROAD AND CLINTON RIVER ROADS (SECTION 19)

-- PROPOSED REZONING FROM RT TWO-FAMILY RESIDENTIAL TO RML MULTIPLE- FAMILY RESIDENTIAL (LOW-RISE)

FILE #5193, DOMINIC MATTINA, D.M. HOMES, INC.

Pertinent correspondence was read and entered into the record. Ms. Trombley noted that 19 notices of this public hearing were mailed to owners and occupants within 300 feet of the land in question, with three being returned as undeliverable.

Dominic Mattina, D. M. Homes, Inc., 1069 Olympia Drive, Rochester Hills, Michigan 48306, explained that he originally planned on constructing four two-unit buildings on this property; however, he would now like to construct two four-unit buildings. He felt this would be a better plan because it will provide more land available for landscaping and will allow for the widening of Hayes Road.

Barry Bergstrom, 37771 Pebble Pointe Court, Clinton Township, Michigan 48038, inquired as to how residents of the proposed development will access Hayes because he stated there is no passageway adjacent to the north and east sides of the property. He felt the traffic in this area is already too congested. He inquired as to whether the proposed units will be rented or whether they will be individually owned. Mr. Bergstrom indicated that he would prefer to see these units individually owned.

Mr. Mattina replied that he is not sure of whether or not the condominiums will be rentals.

Mr. Bergstrom was opposed to the rezoning and felt the project will be a detriment to the area.

Mr. Miller explained the rezoning process and what is being requested at this public hearing.

John Cassisi, 15357 Pebble Pointe Court, Clinton Township, Michigan 48038, expressed confusion as to how a rezoning could permit more units but less buildings. He was opposed to the rezoning request and voiced his concern over the possible environmental damage which may result with the many trees which would need to be cut down. He felt it will be a detriment to the aesthetics of the neighborhood.

Mr. Mattina explained that with the present zoning, he would be forced to remove more trees; however, if he is granted the rezoning, he will have more landscape area available. He assured that the trees which currently abut both the Chateau Mobile Home Park and the adjacent church will remain. He anticipated that some of the Weeping Willow trees will have to be removed. He commented that his plans will have to be reviewed by the Landscape Committee and he felt the residents will have another opportunity to view the plans. He reiterated his previous answer that he is not sure at this time whether the proposed condominiums will be rentals.

Mr. Cassisi inquired as to whether this Commission has the final say with regard to whether the proposed landscape plan will be adhered to and to the issue of rentals vs. Ownership.

Mr. Miller responded that the builder will be forced to comply with any approved landscape plans; however, they do not have any say on the issue of rental vs. ownership.

Some discussion took place among the Planning Commissioners.

Motion by Mr. Gudobba, supported by Ms. Braswell, with reference to File #5193 and application from Dominic Mattina, D M. Homes, Inc., 1069 Olympia Drive, Rochester Hills, Michigan 48306, as represented by Dante Santavicca, 30247 Lund Drive, Warren, Michigan 48093, concerning request for rezoning from RT Two-Family Residential to RML Multiple-Family Residential for 1.147 acres fronting the east line of Hayes Road, between Utica Road and Clinton River Road, that recommendation be submitted to the Clinton Township Board for approval of the rezoning as requested. Roll Call Vote: Aye - Gudobba, Braswell, Dedenbach, Roach, Tomlinson, Woodring, Trombley. Nay - None. Absent - Catalano, Landa. Motion carried.

Further discussion ensued regarding the subject area.

Mr. Miller agreed to look into the complaints regarding the landscaping at Pebble Pointe and report back to the Planning Commission.

ADJOURNMENT

Motion by Ms. Braswell, supported by Ms. Dedenbach, to adjourn the meeting. Motion carried. Meeting adjourned.
